What Wyoming Parents Need to Know About HB 8 and Stalking Laws for Minors

When our daughter was stalked for a year by Marcie Smith, a 41-year-old woman who lives in our small town, we were devastated to learn that in Wyoming, an adult can repeatedly stalk a minor and still face only misdemeanor charges under our current laws. House Bill 8 hopes to change that by making an adult stalking a minor a felony in Wyoming. It recognizes the serious, lasting harm this crime causes to children and families across our state and gives our prosecutors the tools they need to prosecute the criminals who have gone after some of our most vulnerable community members, our children.

This post is intended to help Wyoming parents, educators, and community members understand what HB 8 does and why it matters. We have made it easy for you to take quick, effective action to support stronger protections for our kids by including quick links for you to find out who your local legislators are, form emails/thought starters you can copy and paste, and even a script to help with a phone call if that’s your preferred form of communication.

First, please review the images below that show our proposed changes to Wyoming’s current stalking laws. You can follow this link to read the entire Bill.  Our changes are in red.

Our change makes it so that an adult (18 years or older) stalking a minor is a felony.

What Happens in Wyoming When Someone Is Convicted of a Felony?

Criminal penalties:

  • Up to 10 years in prison, depending on the offense
  • Up to $10,000 in fines, or more depending on the statute
  • Possible probation or parole following incarceration

Loss of firearm rights:

  • Felons cannot possess or own firearms
  • This includes hunting rifles, handguns, and firearms for personal protection
  • Some non-violent, first-time offenders may be eligible to have firearm rights restored after five years
  • Restoration is not automatic, and violent felony convictions often require a pardon

Loss of civil rights:

  • The right to vote is lost while serving a sentence
  • For many non-violent felonies, voting rights are restored after sentence completion
  • The right to serve on a jury is lost
  • The right to hold public office is lost
  • Jury service and public office eligibility may be restored after five years for certain non-violent offenders

Employment and licensing consequences:

  • A felony conviction can significantly limit employment opportunities
  • Many professions require background checks or licensure that may be denied to individuals with felony records
  • Commonly affected fields include education, healthcare, childcare, law enforcement, and government-regulated professions

Travel restrictions:

  • Some countries deny entry to individuals with felony convictions
  • International travel may be restricted or require special approval

 

In cases of adult stalking of a minor, a felony record would significantly restrict or completely bar the offender from working with children in Wyoming. I believe this is an important and necessary protection when child safety is at stake.

How can you help ensure House Bill 8 passes in the 2026 legislative session?

First, use this link to identify your local legislators. Click on Senators or Representatives and search your county to find their email and/or phone numbers.

Then choose your preferred form of communication and let your local legislators know that you want them to VOTE YES for HB 8.

Below are several form emails you can copy, fill in a few personal details, and send to your local legislators. Feel free to make any changes you want to fit your personality. I’ve also included a phone call script in case you prefer to speak with them.

Subject: Please Support HB 8 to Protect Wyoming Kids

[Add 1–2 sentences here about why protecting children matters to you personally or why this issue is important in your community.]

I’m writing as a Wyoming resident to ask you to please support HB 8, which would make adult stalking of a minor a felony.

This bill is a simple but important step toward protecting children and closing a dangerous gap in our current law. Stalking causes real harm, and when the victim is a child, the impact can be long-lasting.

Thank you for your time, your service, and for considering a YES vote on HB 8.

30 Second Phone Call/Message Script

Wyoming’s 2026 legislative session begins Monday, February 9, 2026, and is scheduled to run until March 11, 2026, though the exact adjournment date is subject to change. At this time we do not know when HB 8 will be voted on.
