2023

  • July – Preston was dating K.S. (Marcie Smith’s daughter) but they decided to take a break while still seeing each other, hoping to work things out.
  • August 5, 12:37 AM – Marcie texts Preston about how he worded something to K.S., “I just want you to know she just showed me what you said and it didn’t say exactly what I told you to.” She tells him she just wants to “add him to their family.”
  • August 6-23 – Marcie involves herself in Preston and K.S’s relationship via text. She tells/shows Preston about conversations she has had with K.S., trying to convince her to get back together with him.
    • She discusses K.S.’s upcoming birthday and encourages Preston to go with their family to Water World as planned.
    • Marcie talks about his mom, Brandi, considering moving out of state and suggests he live with them instead.
    • She tells Preston how to ask K.S to homecoming and even buys K.S. shoes, insisting that Preston give them to her for her birthday.
    • Preston expresses frustration about having to act like they’re dating when K.S. says she doesn’t want to date.
    •  Preston admits he talked to Gillian but was not flirting, she says K.S. is upset “get your shit together.”
  • September 2 – via text Brandi and Marcie arrange getting Preston for the Water World trip. During the trip, Marcie buys matching underwear for Preston and K.S., along with other gifts.
  • September 8 – Marcie texts Preston to ask if he wants to go to Rawlins to watch K.S. play, saying she doesn’t want to make his parents mad.
    • She jokes about him wearing his “new lucky underpants.”
    • She asks how K reacted to the shoes and insists he doesn’t need to pay her back, jokingly saying he can repay her “when you marry my daughter.”
    • Their conversation includes inappropriate jokes about how Marcie makes money.
  • September 12 – K.S. gets upset because Preston talked to Gillian in class again, and Marcie gets involved via text
    • Marcie leaves K gummy bears and roses in her truck, telling Preston to say they are from him.
    • She jokes about putting lingerie in K.S.’s truck and making it look like a gift from Preston.
    • Around 9 PM, Preston is frustrated and wants to move on. Marcie tells him to give it time, dress a certain way to make K.S. jealous, and send her pictures of him in his underwear.
    • Marcie also sends screenshots of Preston’s mom looking for jobs in Tennessee, mocking the job and housing situation there.
    • Brandi receives alerts from a parental protection app about “underwear” and, after reading through the messages, decides to confront Marcie.
  • September 13 (Text Conversations)
    • 7:18 AM – Brandi asks Marcie to go to breakfast or lunch.
    • 8:12 AM – Marcie texts Preston: “Should I be nervous that your mom wants to go to breakfast or lunch sometime soon?” Preston says he doesn’t know. She asks if he told his mom about the Facebook thing, and he says no.
    • 9:03 AM – Marcie texts Preston: “I am just trying to decide if she is going to rip my ass for texting with you or about you and K___’s crazy relationship.”
    • 11:46 AM – Marcie finally responds to Brandi: “Yes ma’am we sure can… sorry it has taken me so long to respond…”
  • September 15
    • About 9 AM – Brandi and Marcie meet for breakfast.
      • Brandi expresses concern that the kids are only 15 and should be allowed to just be friends.
      • She brings up the underwear text and says she will be talking to Preston about it—that kind of conversation is not okay.
      • Brandi emphasizes that their family is seriously considering moving, and Preston will not be staying with anyone else. She asks Marcie to stop stressing him about it.
      • Marcie agrees and says she didn’t mean anything by it. The conversation is pleasant, and Brandi leaves thinking everything is resolved.
  • September 19-24 (Homecoming Week)
    • Marcie repeatedly texts Preston about homecoming.
      • K.S. says they can go as friends, but Preston feels uncomfortable. He ends up going with friends.
      • Marcie, as a chaperone, continues texting Preston during the dance, pressuring him to ask K.S. to dance.
      • “All I can say is there is one girl that messed it all up for you.” Blaming Gillian for flirting and trying to break them up. and insists Preston and K.S. will still get married.
      • She asks if he and K.S. are still talking. Preston says they exchange emojis.
  • September 26 (Text Conversation)
    • Marcie asks if K.S. and Preston are talking and if K.S. sent him a long message she wrote.
    • Preston says no.
  • September 29 (Text Conversation)
    • Preston gets heart and kissy-face emojis from K.S.
    • When he responds with emojis, K.S. asks why—she claims she never sent any.
    • They compare screenshots. On Preston’s phone, it looks like K.S. sent emojis, but on K’.S.s phone, it doesn’t show that she did.
    • Preston tells Marcie, and they discuss possibilities. Marcie suggests: “…last night everyone was in bed by 10 … idk if she came back out and got her phone… that is super weird maybe ya’ll’s phones know you’re sad.”
  • October 4 (Text Conversation) – Marcie tells Preston she is going to National FFA and asks if he and K.S. are talking.
  • October 8 (Text Conversation)Preston tells Marcie he is moving on.
  • October 11(Text Conversation)Preston doesn’t talk to Marcie in public, so she texts him: “Don’t be stuck up.”
  • October 14 (Late Night Text Conversation)
    • 10:44 PM – Marcie asks if Preston is sleeping. He says no.
    • She replies “ser” (possibly “serious?”). He asks what she means, but she doesn’t respond.
    • 12:16 AM – She texts “What’s up?” Preston responds “idk” the next morning.
    • She later claims her friends J.H. and M.A. had her phone that night.
  • October 17(Text Conversation)Preston tells Marcie happy birthday. She responds that it’s only her birthday if he’s going to be her son-in-law.
  • October 26(Text Conversation)Marcie comments on what Preston is wearing and asks if he was hoping for compliments.
  • October 31 (National FFA Trip) – (Text Conversation) On the way to National FFA, Marcie asks Preston if he has Life360.

  •  November 6-12
    • Preston receives random texts from an unknown number claiming to be “KD” (a teen from another school).
    • The texter has never contacted Preston before and doesn’t have his number.
    • They start talking about K.S., their breakup, and K.S.’s mom—including comments about how “hot” they both are.
    • They ask Preston for K.S. and Marcie’s numbers.
    • The texter repeatedly insinuates that Preston and K.S. slept together.
    • Preston ignores it at first but eventually responds, saying they never did.
    • They ask if Preston hates K.S.’s family, if he would ever date K.S. again, and if he has a girlfriend.
    • The texter shares things Marcie has allegedly said about Preston and rumors about their breakup.
    • They then ask Preston about those rumors and about Gillian.
    • When Preston stops responding, the texter becomes aggressive, sending pages of one-word messages followed by GIFs.
    • Meanwhile, Marcie is texting Preston about what the anonymous texter is supposedly saying to her.
    • She tells Preston she is hurt that he believes the rumors.
  • Unknown exact date in this time period
    • Brandi and Ryan both receive anonymous text messages from a concerned person about Preston and who he is hanging out with (naming 2 kids in school) and claiming they were behaving badly during the summer.
    • Preston gets a letter in the mail addressed to his parents being concerned with who he is hanging out with.
  • November 15
    • Text messages made to look like they were from Gillian Holman (victim) are sent to Preston and another student W.M. The texts contain disparaging remarks about multiple students, including Preston.
  • November 16 
    • Brandi and her family are on a trip.
    • Brandi and Ryan receive texts from an anonymous number
    • Marcie calls and texts Preston about the anonymous messages at school.
      • He doesn’t want to talk, so he ignores her calls.
      • Marcie then texts Brandi, asking if they’re together because she needs to talk to Preston.
    • Brandi and Marcie discuss the rumors and texts.
      • Brandi tells her she plans to report everything to the police when she returns. Marcie responds “My brother-in-law, who is a cop, said there’s nothing they can do because there are apps that let you change your number…”
    • Preston decides to text Marcie.
      • She asks his side of the story.
      • He explains why he suspects K.S. or her friend is behind the drama.
      • Marcie pressures Preston to talk to K.S. and apologize because she’s hurt that he would suspect her.
      • To get Marcie to stop, Preston reaches out to K.S. and apologizes.
  • November 20 
    • 10:45 AM – 3:03 PM – Anonymous texter messages Preston, claiming to explain who sent the texts and the letter to his house.
      • They say it was because kids at National FFA were talking badly about K.S.
      • They mention using an app called Burner 2nd Number to spoof phone numbers.
    • 3:24 PM – Marcie texts Preston:  “Congratulations that is pretty awesome!!” and includes a screenshot of a Facebook post about him getting ‘All-Conference’ in football
  • November 21 
    • Brandi goes to the police department and files a report.
      • Police say they aren’t sure of the jurisdiction and that spoofed numbers can’t be tracked.
      • They tell her to report back if anything changes or escalates.
      • She texts Marcie she reported it to the police. Marcie asks what they said and responds:
        • “I don’t understand why any of this is happening… and if we do find out who it is, I probably won’t be very nice to them.”
  • November 24 & 27 
    • The anonymous texter messages Preston again.
      • They repeat the same story about who was involved in the drama.
      • When Preston doesn’t respond, they resend the exact message two more times.
  • December 5
    • Marcie tells Preston via text she had ordered a personalized gift a long time ago, and it just arrived. It says: “Love, K___”
    • She asks if he wants it or if it would cause problems for him with the girl he is dating
    • She tells him that she isn’t mad at him “for all that no sense crap that someone had to be so immature and start”
  • December 7
    • Marcie texts and asks Preston if “that crazy number left you guys alone.”
  • December 8
    • Marcie asks via text how wrestling is going.
  • December 19
    • Marcie gives Preston a Christmas present.
    • She also gives the rest of his family a large basket overfilled with treats, snacks, and presents.
      • This is the first time she has ever given them gifts.

2024

  • Cathy and Brandi realize they are both still receiving anonymous messages.
    • Brandi ignored, deleted, and blocked them.
    • Cathy encourages Brandi to report them, saying there is now an assigned officer – Officer Brurud and they can add the messages to the file.
  • February 17
    • Brandi receives an anonymous text claiming that a teacher saw Preston and Gillian being inappropriate at school.
      • The message claims Gillian is a “bully” and a “bad influence.” 
    • Brandi later asks the teacher who says nothing like that had ever happened.
  • February 18
    • Brandi Reports the latest texts to the investigator that Cathy Holman said is on the case.
  • March 22 
    • Preston receives messages from a social media account impersonating his @AlDeaver social media account saying:
      “Hey Hottie”
  • March 25 
    • Message from copycat @AlDeaver account. “Yo Hottie want to hit it tonight”
  • April 12  – State FFA
    • Preston receives messages from copycat @AlDeaver saying:
      • Gillian is a “hoe” and “fkn annoying.”
      • Asking if he got a boner from dancing with her.
      • Claiming their coach/teacher “Wondra was fkn disgusted” watching them dance.
    • Later Preston received screenshots of Gillian and anonymous texter’s conversations that were happening during state FFA
  • April 20 – Prom
    • Brandi and Preston receive messages from an anonymous number claiming to be “a concerned man from their church.” saying he was concerned about the way Preston escorted at prom.
    • Marcie was a chaperone at prom.
  • June 28
    • Brandi receives anonymous texts accusing Preston of being friends with a porn site on Facebook.
  • June 28-30  – Deer Creek Days
    • Marcie approaches Preston and talks to him.
    • Later, she messages him on Facebook since he no longer has his old phone number.
    • She tells him to ‘just please marry my daughter.’
    • Preston later decides to block her on social media.
  • July 11
    • Preston receives anonymous texts with screenshots he had already received before.
      • They make Gillian look like “a bad girlfriend.”
      • The messages say don’t worry about what she does with them in Fargo then (where she was at a wrestling competition).
    • K.S. receives anonymous texts that implicate Preston. K.S. and Preston talk and he assures her he nor Gillian sent anything.
  • July 12 
    • Marcie texts Preston from her personal phone, asking him to marry her daughter (K.S.).
    • Preston unblocked Marcie so he could deny blocking her and calm her down. Marcie then pressured him via Facebook Messenger to talk to her and K.S. on the phone, claiming she had been told that he and Gillian had blocked her.
    • Preston also talks to K.S. to assure her he is not blaming her
  • July 13
    • Brandi reaches out to Officer Brurud
  • July 16 
    • Marcie sends Preston a screenshot (the same one she shared with Cathy on July 11) from her personal phone. And uses it to slander Gillian’s character.
    • Brandi talks with Officer Brurud with GPD to:
      • Report the latest texts, messages, and calls with Preston.
      • Explain how much the situation is stressing Preston out.
      • Ask about options to prevent Marcie from contacting Preston.
  • September 30
    • Preston finds out through the Holmans that Marcie was found out through warrants, was interviewed, and confessed to everything.
    • Preston calls Brandi and tells her
  • October 1, 2024
  • Brandi calls Officer Brurud to ask for information.
  • Officer Brurud says Preston is not considered a victim
    • Brandi Later finds out the earlier harassment before February was not included/connected to the case.
    • Marcie admitted to disliking Gillian but claimed to have no issue with Preston, suggesting he was only targeted to hurt Gillian.
    • Officer Brurud agrees to review any additional information Brandi provides
  • October 2
    • Brandi speaks with the GPD Chief of Police about Preston not being considered a victim and provides additional information.
    • The Chief asks Brandi to submit a statement and more details.
    • Brandi contacts a victim advocate for assistance.
  • October 3
    • Brandi and Preston meet with a victim advocate, who helps them apply for a protective order and advocate for Preston with the police.
  • An ex parte stalking protection order is granted, with a hearing set for November 6, 2024.
  • November 6
    • Sorensen family meets with prosecutors regarding his case and the protective order.
    • The stalking protection order is granted.
  • Charges are filed and cases are combined.
  • December 14, 2024
    • Brandi’s other son encounters Marcie at a grocery store.
    • Marcie sees him, enters the store and continues shopping
    • Police are called.

2025

  • January 7, 2025
    • The Sorensens meet with Nathan Shumway, Converse County Deputy Attorney, to discuss a plea offer for Marcie.
    • The initial offer for both cases includes 3 years of probation and 7-14 days in jail (not necessarily consecutive).
  • January 9, 2025
    • The jail time is removed from the plea offer.
  • February 12, 2025
    • Marcie accepts the plea, court date is set for March 19, 2025.
  • February 19, 2025
    • Patrick Lewallen files for a temporary amendment of bond conditions for February 27 – March 1, 2025 (state wrestling, where both Gillian and Preston are competing). The amendment is granted.
    • Brandi writes a letter to the judge expressing concerns that the bond amendment conflicts with the protection order.
    • The letter is added to the file, and the judge’s clerk confirms via phone that the protection order remains in place.
  • February 25, 2025
    • Dan Holman hand-delivers a letter to Patrick Lewallen stating that the protection order is still in effect and if Marcie attends state wrestling, police will be called immediately.
  • February 26, 2025
    • Patrick Lewallen files an expedited motion to temporarily amend the protection order for February 26 – March 1, 2025 (state wrestling).
    • The motion is denied.
    • Lewallen mails Brandi a copy of the motion and an unsigned “motion granted” document, misleadingly suggesting approval.
  • March 19, 2025
    • Change of Plea Hearing
      • Marcie Pleaded No Contest to Stalking Charges and was sentenced to two years unspervised probation, which is to run concurrently with the sentencing for Gillian Holman’s case.
